These Terms and Conditions (“Terms”) govern your use of formisense.com (the “Site”) and any purchase you make from Formisense (“Formisense,” “we,” “us” or “our”). By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.
Eligibility
You must be at least 18 years old, or the age of majority where you live, to place an order.
Products and product information
We work to describe and show our products accurately, but colors, images and on-screen displays may vary slightly from the product you receive. Specifications are provided by our suppliers and may change.
Important use information. The Formisense detector is a consumer air-quality meter that provides indicative readings for general information and for comparing rooms. It is not a medical device, is not intended to diagnose, treat or prevent any condition, is not a life-safety alarm, and is not a substitute for certified laboratory or professional air testing. Always follow the instructions that come with the product. If you have health concerns, consult a qualified professional.
Orders and pricing
All prices are listed in US dollars. Placing an order is an offer to buy; we may accept or decline any order, limit quantities, or cancel an order if a product is unavailable, if there is an error in price or description, or if we suspect fraud. If we cancel an order you have paid for, we will refund you in full. Prices and availability may change without notice.
Payment
Payment is due when you place your order and is processed securely by Stripe, or by PayPal when that option is offered. Available payment methods are shown at checkout and may include credit and debit cards, Link, Amazon Pay, Klarna and Affirm. Buy-now-pay-later options such as Klarna and Affirm are provided by those companies, are subject to their approval, and are governed by their own terms. You confirm that you are authorized to use the payment method you provide. Any applicable sales tax is calculated at checkout.
Shipping
We currently ship to addresses in the United States, and shipping is free on US orders. Delivery estimates are not guaranteed and may be affected by carriers, weather and other factors outside our control. Once your order ships, we will email you tracking information. Please make sure your shipping address is correct; we are not responsible for orders delivered to an address you entered incorrectly.
Damaged, defective or incorrect items
If your order arrives damaged, defective or incorrect, please email info@formisense.com with your order number and photos of the issue, and we will work with you to make it right.
Accounts
If you create an account, you are responsible for keeping your login details confidential and for activity under your account. Let us know right away if you believe your account has been used without permission.
Acceptable use
You agree not to misuse the Site, including by interfering with its operation, attempting to gain unauthorized access, scraping it in a way that burdens our systems, or using it for any unlawful purpose.
Intellectual property
The Site and its content, including the Formisense name and logo, text, images and design, belong to Formisense or its licensors and are protected by law. You may not copy, reproduce or use them without our written permission, except for personal, non-commercial use.
Disclaimer of warranties
To the fullest extent permitted by law, the Site and products are provided “as is” and “as available,” except for any warranty that is expressly stated in writing by Formisense or that cannot be excluded under applicable law. We do not warrant that the Site will be uninterrupted or error-free.
Limitation of liability
To the fullest extent permitted by law, Formisense will not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Site or products. Our total liability for any claim related to a product will not exceed the amount you paid for that product. Some states do not allow these limitations, so they may not apply to you.
Governing law
These Terms are governed by the laws of the State of Georgia, USA, without regard to its conflict of law rules. Any dispute will be resolved in the state or federal courts located in or serving Henry County, Georgia, unless applicable law requires otherwise.
Changes to these Terms
We may update these Terms from time to time. The version posted on this page, with its effective date, applies to your use of the Site and to orders placed after it is posted.
